Delhi government has made an essentiality certificate mandatory for societies and public trusts that want government or municipal land to open private schools. The amendment to the Delhi School Education Rules, 1973 was notified on September 30, 2026 and changes Rule 44, which deals with opening new schools. The certificate must be issued by the lieutenant governor before any purchase or allotment of institutional land. Applicants must submit details such as proposed location, expected enrolment, existing schools in the zone, building plans, financial resources, fee structure and staff recruitment. The administrator can review these details and conduct inquiries before deciding to grant the certificate. Earlier, the administrator could simply inform the applicant in writing and, if enough schools already existed, deny the request as against public interest. The new rules keep the public‑interest check but add an exception: private schools proposed by societies or trusts on privately owned commercial land no longer need the certificate. That exemption does not apply to land obtained from the government or a municipal corporation, whether at a concessional rate or through auction. The draft amendment was published on August 10 and a 30‑day window for objections received none. The amendment was approved by the Centre under the Delhi School Education Act and came into force after its publication in the official gazette, also removing clause (ii) of Rule 50.## Context The essentiality certificate is meant to ensure new private schools are set up only where there is a genuine need, preventing oversupply in areas that already have enough schools.
