The Gauhati High Court has granted bail to Amritprava Mahanta, a band member of the late singer-composer Zubeen Garg, during an ongoing murder trial.

Case Details And Arrest

Garg died under mysterious circumstances on September 19 last year while swimming in the sea in Singapore. Mahanta is one of seven accused individuals currently facing trial for his alleged murder. She was arrested on October 3 last year after several days of interrogation and is presently lodged at Haflong Jail in Dima Hasao district. Justice Pranjal Das set a bail bond of 50,000 rupees with two sureties of the same amount, alongside conditions that include the submission of her passport.

Legal Stance And Next Steps

Mahanta's lawyer, Anan Kumar Bhuyan, stated that the prosecution has nothing concrete against his client and that she was falsely implicated. Her lawyers must now submit the bail bond to the trial court for acceptance before she can be released. Meanwhile, prosecution lawyer Ziaul Kamar noted that authorities are awaiting the detailed court order to examine the basis for the bail and will consult the state government regarding a potential appeal.

Background

Garg's death led to widespread demands across Assam for a proper investigation, prompting the state government to form a special investigation team that concluded the singer was murdered in a planned conspiracy. Six other individuals, including Garg's manager, an event organiser in Singapore, another bandmate, a cousin, and two security officers, remain in jail in connection with the case, though the two security officers previously received bail in a separate disproportionate assets case.

Context

High court bail hearings in serious criminal cases typically involve a careful review of police case diaries, evidence gathered by investigators, and arguments from both defense and prosecution lawyers regarding whether continued pre-trial detention is necessary. When courts grant bail under specific conditions like bond payments and passport surrender, it allows accused individuals to await their trial outside of prison custody without closing the ongoing legal proceedings against them.
