The Supreme Court on Monday stressed the need to balance religious feelings with public health when looking at limits on firecrackers in the national capital and nearby areas. Chief Justice of India Surya Kant leads a three-judge Bench hearing the case. During the court session, Justice Joymalya Bagchi raised a question about the religious reasons behind bursting firecrackers. Senior advocate and amicus curiae Aparajita Singh spoke about the health dangers of air pollution, especially for children, older adults, and people with existing health problems. She proposed that the Commission for Air Quality Management focus its attention on these medical issues.

Ground Realities

The Bench warned against putting rules in place that are hard to enforce in reality. The Chief Justice stated that authorities need to make people wiser, build awareness, and inform them about which firecrackers cause harm and which cause less harm. He proposed pushing a culture based on traditional methods like lighting lamps and using sparklers, along with limits on selling dangerous types of crackers.

Context

Air quality in the national capital and surrounding areas often worsens significantly during certain seasons, prompting legal interventions and policy discussions on pollution control. Courts frequently deal with the challenge of balancing cultural practices with environmental protection and public health concerns. The matter will come up for hearing next on October 15.
