The High Court of Karnataka has refused to drop a charge of culpable homicide not amounting to murder against a father after his 14-year-old son drove a car and caused a fatal accident that killed three members of a family. Justice M. Nagaprasanna dismissed the criminal petition filed by Nadeem from Mysuru, who had asked the court to quash the charge sheet against him.

The Incident And Court Ruling

The tragic crash happened on December 10, 2020. The petitioner's minor son took a car for a drive, drove it at high speed, lost control, hit a road divider, and crashed into a motorcycle. The collision killed a couple and their five-year-old child, while another child was injured. While the petitioner claimed his son took the car without his knowledge, the court noted that charge sheet materials showed the father was in the habit of letting his son drive repeatedly and had handed him the keys on that day. The court stressed that a parent who consciously gives a vehicle to an underage child cannot escape responsibility when tragedy strikes, ordering the case to go to trial.

Context

This case highlights strict judicial scrutiny regarding parental accountability and the rising dangers of underage driving on public roads. Under Indian law, giving a vehicle to a minor who is not legally allowed to drive can lead to severe criminal charges if it results in fatal accidents.
