The Employees' State Insurance Corporation has extended its dispute resolution plan by three months until December 31, 2026. A Labour Ministry statement said the move follows requests from various groups.
Scheme Details
The New Amnesty Scheme, 2025, ran from October 1, 2025, to September 30, 2026, and is now open for three more months on the same terms. It serves as a one-time initiative to cut down pending court cases and build better compliance under the ESI Act. Court cases filed up to March 31, 2025, are eligible for this out-of-court settlement mechanism.
Settlement Rules
The plan lets employers settle ad-hoc assessments by paying just their actual contributions and interest, while authorities waive any extra damages. Employers who already cleared their dues can withdraw their cases by paying 10% of the disputed damages. Additionally, cases filed by the agency for delayed payments or missing records can be withdrawn with court permission if the employer has since complied.
Context
Schemes like this help reduce the heavy workload of courts by encouraging people and businesses to clear old legal disputes outside the courtroom. Such steps are commonly used by government bodies to clear long-standing disputes and encourage voluntary compliance among employers.
