The Supreme Court announced on Wednesday that it will not place a complete ban on firecrackers, but it will also not permit people to burst them all day long. A bench consisting of Justices MM Sundresh and PB Varale stated that a middle path is necessary by setting fixed time slots for bursting crackers. The judges noted that a total ban would hurt public feelings, while allowing them around the clock would severely harm living beings, especially senior citizens, patients, and young children. During the court proceedings, Additional Solicitor General Aishwarya Bhati presented a note suggesting that authorities might allow limited and conditional relief for specific next-generation joined green crackers. These items are recommended by CSIR-NEERI and meet required standards for noise, emissions, and safety. Researchers developed these linked fireworks with lower levels of barium salts to cut down pollution. The submitted note added that these products should come only from licensed makers, stay within the noise limit of 125 to 145 decibels, and avoid banned chemicals. The top court will next examine the matter regarding barium use on October 15.
Context
Courts frequently balance traditional celebrations with public health concerns during festival seasons, particularly regarding air and noise pollution in urban centers. Green crackers were introduced as an eco-friendly alternative to traditional fireworks to reduce harmful emissions while preserving cultural practices. Decisions on these matters typically aim to protect vulnerable populations from hazardous smog without completely halting seasonal festivities.
