Navi Pillay leads the United Nations Independent Inquiry Commission that recently found Israel has committed genocide in Gaza, marking a historic first for a UN body. Ms. Pillay, 83, heads the three-member panel alongside Miloon Kothari and Chris Sidoti, though all three members have submitted their resignations to step down later this year due to age, health and other commitments.
Background
Born in South Africa in 1941 to Tamil parents, Navanethem 'Navi' Pillay became the first woman to start a law practice in her home province of Natal in 1967, where she defended anti-apartheid activists and prisoners on Robben Island. Nelson Mandela's government appointed her as Acting Judge of the High Court of South Africa in 1995, and she later served on the International Criminal Tribunal for Rwanda, the International Criminal Court, and as the UN High Commissioner for Human Rights. Earlier this year, she received the Sydney Peace Prize.
Findings and Reactions
The Commission's report concludes there are reasonable grounds that four of five acts constituting genocide under the 1948 Genocide Convention have been carried out against Palestinians in Gaza. The findings cite statements from Israeli leaders including President Isaac Herzog, Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant. Over 64,000 people have died in Gaza since the war began following a Hamas-led attack on October 7, 2023 that killed around 1,200 people and took 251 hostages. Israel has strongly rejected the report as false, called the authors Hamas proxies, and demanded the Commission be abolished.
Context
The United Nations maintains that only a competent court like the International Court of Justice can make a final legal determination of genocide. South Africa has already brought a genocide case against Israel at the ICJ, though a final resolution can take several years.
ExplainerWhy this matters
What Happened
The UN Independent Inquiry Commission on the Occupied Palestinian Territory released a report concluding that Israel has committed genocide against Palestinians in Gaza.
Why It Matters
This marks the first time a UN-affiliated body has formally used the term genocide regarding the current conflict in Gaza. While the UN clarifies that only courts like the International Court of Justice can legally decide if genocide has occurred, findings from expert UN bodies carry significant diplomatic and political weight globally.
What Happens Next
All three members of the Commission are stepping down later this year after submitting their resignations. Meanwhile, the legal case brought by South Africa against Israel at the International Court of Justice will continue, though a final verdict could take years.
