The Telangana High Court has imposed a fine of twenty-five thousand rupees on the School Education department for filing an appeal 250 days late. A bench of Acting Chief Justice P. Sam Koshy and Justice Narsing Rao Nandikonda allowed the appeal reluctantly. The court ordered that the money must be deposited with the State Legal Services Authority within two weeks. Judges also instructed the Principal Secretary for Education to find out which officer caused the delay. The bench stated that the department can recover the money from the responsible official if needed.

Background

K. Girish filed a petition in 2016 to get absorbed as a grant-in-aid teacher based on a proposal sent by Vivek Vardhini Education Society. The society sent this proposal in 2003, but the School Education department rejected it two years later. The petitioner passed away while the plea was still pending in court. On September 23 of last year, a single judge ordered the Hyderabad District School Education Officer to absorb the deceased person and provide all related benefits. The division bench stayed this single judge order after noting that a strong case was made because the petitioner died before the final order.

Context

Courts in India frequently penalize government departments for delays in filing legal papers to prevent unnecessary waste of judicial time. When costs are ordered against official bodies, courts often direct authorities to recover the amount from the salaries of the specific officers at fault. This legal process ensures accountability within public administration and pushes government offices to handle court cases faster.
