An audio clip sent by one of the accused in the Nedumbassery luxury car crash has emerged as crucial evidence as the Ernakulam Additional District Court considers bail pleas.

Court Proceedings and Bail

The prosecution presented the audio clip on Monday, October 26, 2026, to oppose the bail applications of the four accused, arguing that further police custody is needed for detailed interrogation. The defence countered that more custody is unnecessary and that abetment charges against accused numbers two to four will not stand. The court has reserved its verdict on the bail pleas for October 28. Earlier, on October 17, the Judicial First Class Magistrate Court in Angamaly had already rejected bail for all four individuals, noting concerns that the accused might try to influence witnesses or tamper with evidence.

The Incident and Investigation

The fatal accident took place on October 11 around 1.45 a.m., killing three young people: 21-year-old Devika, 22-year-old Gopika, and 21-year-old Ijaz. Police arrested four 19-year-olds in connection with the crash: Suhail Sajeev, who allegedly drove the car while heavily drunk at around 165 kmph, alongside three co-passengers named Ninav, Ameen Sha, and Joyal S. According to investigators, Joyal fled the scene and later sent an audio message to a friend detailing that Suhail was drunk, sped, hit three youngsters on a scooter, called his father right after the crash, and shared news links about it. Suhail and Ninav were caught at the spot, while Ameen and Joyal were arrested the next day in Alappuzha. Investigators are also trying to trace more witnesses and have tracked down a key eyewitness who is an online cab driver.

Background and Fallout

Police previously stated that Suhail visited three bars before the crash and had a blood alcohol content five times over the permissible limits. The Excise Department suspended the licences of those three bars for serving alcohol to an underage person. The tragedy drew wide media attention, was raised in the Assembly by the Opposition LDF, and sparked controversy after Suhail was sent to a Borstal school instead of a prison. Additionally, a counsel for one of the victim's fathers noted that Suhail shouted that his father would take care of everything.

Context

Bail hearings in serious criminal cases often involve prosecutors presenting digital evidence like phone recordings to convince judges that releasing suspects could harm the ongoing investigation. Underage drinking laws and bar licensing rules are strictly enforced in such cases to hold establishments accountable when minors are served alcohol before fatal incidents.
